Lastly, there is no legal basis for the disbanding of the chapter because Article XVI of our Constitution only states the suspension and expulsion of members but not the disbanding of a chapter.Our Constitution does not provide for the grounds required to disband a chapter, therefore , the act of the Provincial Council is not valid and it contravenes the Constitution. It is tantamount to abuse of discretion amounting to lack or excess in jurisdiction.

The Kabalikat Civicom 4th District of Laguna Chapter has been very active, efficient, dedicated, organized and determined in serving the people of Laguna particularly the 4th District. The group was very much involved in the rescue operations during the Ondoy, Santi and Pepeng typhoons IN 2008.It has also been very active in the yearly Lakbay Alalay during the Lenten Season where the members responded to help in road accidents thus saving precious lives.

In view of the foregoing, we are asking the National Executive Council to reconsider the said decision of the Laguna Provincial Council in the interest of service to mankind. We are appealing to you to let us, members of the Kabalikat Civicom 4th District of Laguna continue our mission of serving the people with utmost dedication and professionalism so that we can contribute to the national progress.

KABALIKAT CIVICOM ASSOCIATION INC.
NATIONAL EXECUTIVE COUNCIL

Dear Sir Gil (10-01) ,

This is to respectfully appeal the decision of the Kabalikat Civicom Laguna Provincial Council which is already final and executory to disband the Kabalikat Civicom 4th District of Laguna Chapter as a regular chapter effective July 10, 2011 due to gross violations of Constitution and By-Laws.

We regret the said decision of the Council because we were not accorded due process in the said case as provided for in Section 4. Article XVI of our Constitution.There was no notice and hearing where we could have been given the chance to present evidence and effectively explain our side.

Second, we firmly believe that it is only the National Executive Council who has the power and jurisdiction to disband a chapter and not the Provincial Council. Our Constitution in Section 5. Article XVII states that “ No other Kabalikat Chapter or group shall be officially recognized in the same or unless the same is chartered through by the Kabalikat National Founder.” From this statement it can be deduced that impliedly the National Council has also the sole jurisdiction and power to disband a chapter.

Thirdly, we do not approve of the way the Provincial Council communicated the disbanding of our chapter. A letter was sent to Hon. Governor Jeorge “E.R.” Ejercito Estregan informing him that the Kabalikat Civicom 4th District of Laguna Chapter was disbanded and no formal letter was sent to us but only a handwritten note with no signatory.Some members learned of the verdict only thru the said letter sent to the governor.As longtime and active members of Kabalikat Civicom who have served the public unselfishly, we deserve a little bit of courtesy by being the first ones to be informed of the decision and not thru other channels.
